Probably, it is difficult to imagine modern logistics without cars, airplanes, trains and steamers, which transport various cargoes on the whole planet. Every day, in ports and air terminals there is no estimated quantity of goods from different parts of the world. Not unimportant is storage in warehouses. Warehouses can be divided into two categories.
- Warehouses of temporary storage - a place where cargo is usually not delayed for a long time, but simply awaits loading for shipment.
- Long-term storage warehouse - often warehouses where the cargo is stored for a long time, from which it is subsequently sent to the nearest regions.
Also the warehouses are cold and warm. After all, for different groups of goods, a different method of storage is required, regardless of whether this warehouse is temporary or intended for long-term storage.
For the safety of goods, warehouse owners make a lot of effort. Install cameras, hire expensive security and constantly improve security measures. It's not surprising considering the cost of the stored. However, regardless of the measures taken and the amount of money spent on security, it is not uncommon for the cargo to be damaged in the warehouse, and rarely after which it becomes completely useless.
Regardless of the warehouse in which the cargo is stored and in what conditions the warehouse that accepted it for storage bears responsibility for it to the owner. The responsibility of the warehouse, as well as the responsibility of the carrier, can be insured, but do not forget about exceptions from the policy of a number of cases. For example, not all insurance companies are willing to pay insurance in the event that the cargo has received damage to the package or simply rotted if the storage conditions are violated.
Not everyone knows, and the fact that large stores are fastidious not only to damaged goods, but also often refuse to accept goods with a breach of packaging. A store that sells goods in accordance with the law is responsible for the goods sold. In this connection, in case of damage to the packaging, there is a risk of damage to the goods. It is absolutely not important whether it is possible to visually determine the defect or not. Problems with the goods can arise during the warranty period. In this case, if the manufacturer proves that the defect is caused by wetting or shaking the store, you will have to answer to the buyer yourself.
The damage to goods in the warehouse is mainly due to the fault of ordinary employees. The most common case is:
- Falling of the goods from the loader
- Wrong placement of goods in the warehouse
- Damage caused by the leaking of the warehouse roof
- Not careful handling of packaging during unloading or loading
- Mechanical damage from the loader or hoist
In all these cases, the liability of the warehouse to the owner of the cargo is obvious. Questions arise when making claims to the warehouse. The warehouse owner does not always be able to recover the damage from the employee and as a result tries in every possible way to prove that the claims are overstated. Also, the owner of the cargo is not always honest and exposes as a claim not only the cost of the damaged cargo, but also the lost profit.
In case your cargo is damaged during storage in the warehouse, you need to call the surveyor. The specialist will fix the amount of damage, assess the amount of the loss incurred and determine the circumstances and causes. The report of an independent surveyor may serve as evidence in court or justification in the dispute between the owner of the goods and the warehouse that accepted it for safekeeping. Remember that when creating a contract of responsible storage, the liability of the warehouse should be spelled out. In the future, this can shorten the time to compensate for the damage.
